Real estate law: Freehold and leasehold acquisitions
How do I buy in full ownership ?

Apartment
It is possible for a foreigner to buy a freehold apartment in Thailand under the following conditions:
- Buying in a building with a Condominium License
- Acquire it within the “foreign quota”, which represents 49% of the residence’s living area.
- Transfer all funds covering the purchase from abroad in foreign currency.
Example: You can purchase a fully furnished apartment for €100,000 in a renowned beach resort such as Phuket or Koh Samui, enjoy rental income and/or stay there legally, with the option of long-term ownership transfer.
How do I buy a leasehold villa in Thailand?

Villa
It is possible to legally purchase a villa in Thailand. Since the law does not allow a foreigner to own land in their own name, the legal solution is:
- Purchasing on a leasehold basis: a lease for a maximum term of 30 years. Renewal is possible but must be negotiated at the end of the first 30 years.
Example: You can buy a 2-bedroom house with a pool for €200,000 with a 30-year leasehold on the land. You can live in, rent out, or resell the villa throughout the term of this lease.
Resale

You are free to resell your property just as freely as you purchased it and to repatriate the funds to your home country.
